Americans with Disabilities Act Personnel

The Americans with Disabilities Act (ADA) of 1990, 42 U.S.C. 121101 prohibits discrimination against a qualified individual with a disability with regard to job application procedures; the hiring, advancement, or discharge of employees; employee compensation; job training; and other terms, conditions, and privileges of employment.

An employer/covered entity must make reasonable accommodations to the known physical or mental limitations of an otherwise qualified individual with a disability, who is an applicant or employee, unless such covered entity has demonstrated that the accommodation would impose an undue hardship on the operation of the business. However, each individual is responsible for initiating the request for reasonable accommodation, if they believe such accommodation is required to enable them to perform the essential functions of the job.

In accordance with the law and regulations the Secretary of State's Office will fully comply with ADA accessibility guidelines and will inform employees and applicants about the Secretary of State's policies and the right to reasonable accommodations and to provide any and all such reasonable accommodations in the most cost-effective manner available, unless it would impose an undue hardship.
